The Cabinet of Ministers has clarified the procedure for reserving persons liable for military service during martial law, according to the Ministry of Economy of Ukraine.
The Ministry reminded that from 1 December, reservations for persons liable for military service will again be made through the Diia portal. At the same time, all critical enterprises must confirm their status by 28 February 2025 in accordance with the new criteria.
On 15 November, the Government completed an audit of decisions regarding the designation of enterprises, institutions, and organisations as critical. According to the results of the audit, 95% of all critical enterprises have retained this status.
The Ministry of Economy reported the following violations identified during the audit:
“Thanks to the audit, we were able to identify minor violations and prepare changes to address them. The new parameters for reservations and the critical status of enterprises are now clearer, ensuring a balance between the state’s defence capabilities and the economy. Based on the audit results, enterprises found to be in violation have lost their critical status, and their employees’ reservations have been annulled. We also streamlined the approval process for sectoral and regional criteria for the criticality of enterprises. Only those that truly contribute to the economy and have a legitimate right to be reserved will be considered,” said Deputy Minister Vitaliy Kindrativ, according to the Ministry of Economy’s press service.
Based on the audit findings, the Government has decided to update the booking criteria to make the system work effectively for both the country’s defence and economy.
The process for recognizing enterprises as critical has not changed. As before, companies apply to the relevant Ministry or CAA to obtain this status.
The Government has maintained the eight existing criteria for determining whether an enterprise is critical. However, sectoral and regional criticality criteria are now agreed upon by the Ministry of Defence and the Ministry of Economy.
For private enterprises, a mandatory criterion has been established: the accrued average salary of employees for the last calendar quarter must be at least 2.5 times the minimum wage (UAH 20,000 as of 15 November 2024). The employee being booked must also have an accrued salary of at least UAH 20,000.
A mandatory criterion for all companies is the absence of arrears in tax payments.
Businesses that wish to reserve an employee must confirm that they meet both current and new criteria. They have more than three months to do so—until the end of February 2025.
Once criticality is confirmed, companies must submit new employee lists for booking via Diia. Until these updated lists are submitted, existing bookings will remain valid.
The employee booking system through Diia will be launched on 1 December. This system eliminates the human factor and accelerates the process.
Companies are prohibited from reserving employees who are not registered for military service or do not have military registration documents.
All decisions to designate companies as critical will be monitored, with the possibility of cancelling the reservation. This option will be available through the Diia portal.
Monthly monitoring will be conducted to ensure that companies comply with the established requirements, including average salaries, tax payments, and the number of persons liable for military service.
If a company is found not to meet the requirements, it will be asked to provide an explanation. If the monitoring result is negative, the company will lose its critical status.
